When you receive a traffic citation/ticket, you have 30 days from the date of the citation/ticket to elect one of the following options:
Option 1: Pay your Citation/ticket
You can choose to pay the fine to the Clerk's Office within 30 days of the date of your citation/ticket. This choice means that you do not contest the citation/ticket and, subsequently, forfeit your right to a hearing. This option will be treated as a guilty plea. As a result, you will have a conviction on your record and the Division of Driver's Licenses will automatically assess the appropriate number of points against your license, which may cause an increase in your insurance premium or result in a points suspension of your license.
Note: Even if you have already paid the citation/ticket, you may still have a right to request a hearing (or hire our firm) within 30 days from the date the citation/ticket was issued.
Option 2: Elect Driving School
This option will require you to pay a slightly reduced fine, as well as pay the costs of attending the driving school, but you will receive no points against your license. However, you may only attend driving school once per 12 months. Be aware that Commercial Drivers License (CDL) holders are ineligible to elect driving school.
Note: Even if you have already elected this option, you may still have the right to request a hearing (or hire our firm) within 30 days from the date the citation/ticket was issued.
Option 3: Request a Hearing
You may request a hearing by contacting the Clerk's Office yourself. A hearing date will be set for your case to be heard in open court by a Judge.
Note: In Gainesville/Alachua County, citation/ticket cases may have two hearings. The first hearing is an arraignment only where the defendant has an opportunity to attempt a plea bargain. If your case is not resolved at arraignment, there will be a second hearing. At this second hearing, the law enforcement officer who issued you the citation/ticket would be required to appear to prove his/her case against you. Your responsibilities in court will be to testify as to your version of the facts, cross-examine the officer, and present your own witnesses, if any.
Option 4: Hire The Traffic & Accident Attorneys to Handle Your Case
Certain types of citation/tickets are based on technical evidence gathered by radar, laser, or aircraft. There are several laws that govern the use of such evidence in court. Avoiding points on your license may be important because, depending on your individual circumstances, your insurance rates could increase or you may be facing suspension for too many points on your license.
